Simply put, it’s easier to file legal claims in civil courts in Canada and the United States than it is in Europe. This form evolved out of the 1970’s and 1980’s to provide evidence that the service provider (me) has adequately informed the customer (you) of the inherent risks in the activities we will participate in. It does not absolve me or anyone working with Simmons Mountain Works from Gross Negligence. All guests who reside in North America are required to sign this document without edits prior to beginning our trips. These forms will be kept on file for 7 years before being deleted. Guests who reside outside of North America are not required to do so, but it is a kindness for my record-keeping if you do.
