Terms & Conditions of Services

Simmons Mountain Works strives to create these Terms and Conditions to be fair to all parties. By making any payments, you are agreeing to these terms. When enough notice is given, a trip may be cancelled and a refund issued minus any administrative and logistical fees that could not be recovered. Upon receiving your deposit I am committing my time to your trip, and as the dates of your booking comes closer, my opportunity to find alternative work becomes less likely. Therefore, a component of your payment compensates for my professional time required to operate your trip. In some circumstances, rescheduling may be offered. The following terms are only applicable for payments made directly to Simmons Mountain Works.

Trip Insurance can cover almost every one of the following circumstances - which is why Simmons Mountain Works strongly encourages and will assist with getting appropriate Trip Insurance for guests.

Your Commitment When Booking Domestic or International Trips of Activities

Trips in the United States and Canada will be booked with third party guide services. Their Terms and Conditions will be preemptive, and Simmons Mountain Works will work with you as best as I can within those Terms and Conditions.

Should you refuse to sign any Release Agreement, Acceptance of Risk Forms, or refuse to agree to any Terms and Conditions, you are not entitled to participate in any trip or garuntee any refund of payments.

Should you arrive late to a predetermined location at the start of your booking, you are not entitled to participate or receive any refunds. Simmons Mountain Works will attempt to communicate with you and reschedule in good faith, but no guarantees are made and the trip may be cancelled.

When Simmons Mountain Works Cancels Your Booking

On the rare occurrence that Simmons Mountain Works cannot offer you the product sold as a result of hazardous conditions of any nature, or any unforeseen circumstances which cannot be overcome, Simmons Mountain Works reserves the right to change the product destination or cancel out right due to circumstances beyond control. These circumstances include but are not limited to acts of man (war, terrorism, third-part logistics providers, etc.) or acts of nature (severe storms, earthquake, fire, etc) and situations regarding guest or guide safety.

Simmons Mountain Works reserves the right to cancel bookings in such circumstances, or provide full account credit for a booking with the next 6 months if rescheduled in the next 30 days after the cancelation is communicated to the guest. Should the guest fail to reschedule within the 30 days, the account credit is forfeit.

Simmons Mountain Works is not responsible for any additional expenses incurred by rescheduling, including non-refundable airline ticket, equipment, lodging, and all other related travel expenses.

When a Government Agency Prevents Your Booking From Taking Place

In the event that any government agency, domestic or international, restricts travel or activity in such a manner that Simmons Mountain Works is unable to continue providing you the booking you purchase(i.e. travel ban, etc), your circumstances will be examined on a case by case basis. Appropriate Trip Insurance protects you in such circumstances, and since Simmons Mountain Works is making a reasonable effort to make you aware of this protection, the cancelation policy state above will be considered along with the timing of events and unrecoverable fees paid when arranging your booking.

When You, The Guest, Cancel a Trip

All requests for rescheduling or refunds must be made in writing. For any payments made to third party guide services, the third-party guide services are preemptive.

For all trips booked and payments made with Simmons Mountain Works, all requests must be made by 91 days before the first day of the booking. If you wish to reschedule, you will have 30 days to reschedule within the next 6 months. If you request a refund, or if Simmons Mountain Works is unable to accommodate your rescheduling, you may receive up to 90% of the total amount of your booking, minus any payments not received, unrecoverable fees related to the logistics of your trip, and an additional administrative fee at the discretion of Simmons Mountain Works of 0-15% of your total amount.

Simmons Mountain Works reserves the right to refuse refund for any requests made within 90 days. If you fail to meet deposit or payment requirements as stated in invoices, Simmons Mountain Works reserves the right to cancel your booking, refuse any refund, and make the dates available for other commitments.

Group Cancelation

Regardless of the form and aggregate of payment, each guest is connected to an individual fee from Simmons Mountain Works. If payment is received in the form of one sum for several guests in a trip or booking, each deposit and final payment is applied to the individuals regarding cancelation. IF one guest of a group aggregate payment requests a rescheduling or refund, the cancellation policy still applies as stated above.

Personal Responsibility

By making payment and registering in a Simmons Mountain Works trip (a booking) you certify that your are full capable of the activities described in this website. You therefore assume full responsibility for yourself, including your dependent minors, for bodily injury, death, loss of personal property or expenses thereof as a result of the inherent risks and dangers and of your own negligence in participating in this activity. You are achknowledging by making booking that Simmons Mountain Works has made available the nature and physical demands of this activity including the risks, hazards and dangers associated with it. If you are still unsatisfied with your understanding of what is required, you have the right to contact Simmons Mountain Works for further communication. It is your responsibility to self-assess throughout the activity to ensure as safe a trip as possible. You must honestly and accurately describe yourself, your fitness, your skills, and the condition of your equipment to Simmons Mountain Works. You must adhere to the instructions of your professional mountain guide.

All Products are Attempts

Simmons Mountain Works cannot guarantee that you will reach the summit or complete the goals of every booking. Weather, route conditions, your skills, or any safety or logistical concern may create circumstances that make a trip unsafe or a goal unobtainable. You must accept these parameters as determined by the guide. This action will not result in refund or rescheduling.

Unfortunate Expenses

You understand and acknowledge that events may occur that cause additional costs unforeseen at the time of booking. Dirsuptions may include but be limited to rescue, evacuation, disruption of travel reservations, natural disasters, theft, medical treatment or transport, loss of wallet and passport, loss or delay of luggage, political unrest, terrorism, or pandemic. Simmons Mountain Works is not responsible to cover the costs or compensate for such unexpected expenses.

Photographic Release

You agree that by making any payment to Simmons Mountain Works that Simmons Mountain Works reserves the right to take any photographs or film records of any trip or activity conducted by Simmons Mountain Works. You agree that Simmons Mountain Works may use such material for promotional and/or commercial purposes.
